Section 01

1. Agreement

By accepting a quotation, booking a service, making a payment, or allowing work to commence, you agree to these Terms and Conditions.

Section 02

2. Our services

We provide services on an hourly basis unless otherwise agreed in writing. Services may include lawn mowing, edging and brush cutting; pruning, hedging and topiary; weeding and garden maintenance; property clean ups; mulching, planting and horticulture; green waste management; landscaping assistance, paving, concreting and stone work; turf install, synthetic turf and steel edging; pressure washing, gutter cleaning and slashing; and general outdoor property maintenance. You're welcome to request specific tasks. How much we complete depends on the time booked, site conditions, weather, and the condition of the property.

Section 03

3. First visit and time estimates

Your first visit is a booked hourly service, with the hours chosen by you. During this visit we assess the property, identify your requirements, work out the recommended scope, and get stuck into the work you've requested. After the first visit, we may provide an estimate of the labour hours needed for ongoing maintenance or larger projects. Estimates are given in good faith based on the property's visible condition at the time. Actual hours can vary due to weather, access difficulties, hidden obstacles, extra requests, or changes in the property. Time estimates are not fixed-price quotations unless we expressly state a fixed price in writing.

Section 04

4. Quotations

Written quotations are valid for 30 days unless stated otherwise. Quotes are prepared from what's visible at inspection. If something unforeseen comes up during the work, we'll discuss any additional costs with you before proceeding.

Section 05

5. Scope of work

We perform the work outlined in the accepted quotation, work order or verbal agreement. Additional services you request may be quoted separately or charged at the applicable hourly rate.

Section 06

6. Pricing and variations

Prices include labour and any materials specifically identified in the quotation. Variations you request after accepting a quote may attract additional charges. We will never apply a variation charge without telling you first.

Section 07

7. Hourly rates

All hourly services are charged at our current advised rate. Labour is calculated from arrival on site until completion, including loading and removal of green waste where applicable. Materials, disposal fees, equipment hire and purchased products are charged separately unless the quote says otherwise.

Section 08

8. Discounts and pre-payment

Pre-payment discounts: 5% off when you pre-pay 10 or more estimated labour hours, 15% off when you pre-pay 20 or more. Pre-payment discounts apply only when payment is received before work commences, can't be combined with other offers unless we approve it, and may change for future bookings. Unused pre-paid hours stay as credit on your account, or can be refunded on request less any costs already incurred.

Seniors discount: we proudly support the senior members of the Ballarat community with a 10% discount for customers who are 65 or older and not already receiving gardening assistance through a Home Care Package, CHSP, NDIS funding or another government-funded care package. We may ask for proof of age. The seniors discount can't be combined with other offers unless we approve it.

Section 09

9. Ongoing maintenance programs

Regular visits are available weekly, fortnightly, monthly or seasonally. After your first visit we can recommend a schedule to suit your budget and the property's needs. Regular maintenance customers may receive priority scheduling.

Section 10

10. Payment terms

Payment is due within 7 days of the invoice date unless agreed otherwise in writing. For projects with substantial materials, equipment hire or extended labour, a deposit of up to 50% may be required before work starts. Materials we supply remain our property until all invoices are paid in full.

Section 11

11. Late payments

Overdue accounts may incur reasonable administration and debt recovery costs where the law permits. We may suspend future services and withhold scheduling until outstanding accounts are settled.

Section 12

12. Access and your responsibilities

Please provide safe and reasonable access to all work areas, and tell us before we start about any known underground services, electrical cables, septic systems, irrigation systems, retaining walls, property hazards, or property boundary locations. Pets must be secured and children supervised while work is underway.

Section 13

13. Weather delays

Services may be postponed or rescheduled due to rain, storms, high winds, extreme temperatures, unsafe ground, or other circumstances beyond reasonable control. No penalty applies for weather or safety delays, and we'll rebook you as soon as we can.

Section 14

14. Green waste

Unless your quote includes it, green waste removal is charged separately. By agreement, green waste can be removed from site for a fee, placed in your green waste bin, or left in a spot we agree on together.

Section 15

15. Plant and lawn health

Gardens are living things, influenced by weather, watering, soil, pests, disease and how they're looked after between visits. We can't guarantee the survival, growth, colour or ongoing health of plants, turf, trees or landscaping materials unless specifically agreed in writing.

Section 16

16. Property damage

We work with reasonable care and skill. We're not responsible for damage arising from hidden or undisclosed underground services, existing defects in paving, irrigation, drainage, fences or structures, dead or unstable trees and plants, undisclosed site conditions, or pre-existing property defects. Any concern about alleged damage must be reported within 7 days of service completion.

Section 17

17. Cancellations and rescheduling

Life happens, and we'll always try to accommodate changes. Cancel or reschedule without charge with at least 24 hours notice. Cancellations inside 24 hours may incur a fee of up to one hour's labour. If we attend and can't access the site or start work for reasons outside our control, a call-out fee or minimum one-hour charge may apply. Repeat short-notice changes may mean pre-payment is required for future bookings.

Pre-paid services cancelled with more than 24 hours notice stay as account credit. Refunds are less any work already completed, materials purchased for you, disposal fees, and other non-recoverable expenses.

If we cancel due to weather, illness, equipment failure or safety, you won't be charged anything and we'll reschedule at the next available opportunity. Regular customers can pause visits for holidays, hospital stays or personal circumstances by mutual agreement.

Section 18

18. Your consumer rights

Nothing in these terms excludes, restricts or modifies your rights under the Australian Consumer Law. We'll provide services with due care and skill, and within a reasonable time where no completion date has been agreed.

Section 19

19. Ending a maintenance agreement

For recurring arrangements, either of us can end the agreement with 14 days written notice. Invoices issued before termination remain payable, and unused pre-paid services are refunded less costs already incurred.

Section 20

20. Disputes

If there's ever a dispute, we both agree to first try to sort it out through direct, good-faith discussion. If that doesn't resolve it, either party may seek help from the Victorian Small Business Commission, Consumer Affairs Victoria, VCAT, or another appropriate dispute resolution service before commencing legal proceedings.

Section 21

21. Privacy

Personal information we collect is used only for providing services, preparing quotes and invoices, communicating with you, and meeting legal obligations. We don't share your information with third parties except where the law requires it or it's necessary to deliver the service you've requested.

Section 22

22. Governing law

These terms are governed by the laws of Victoria, Australia, and any legal proceedings will be conducted in Victoria.
